Reaffirmation Agreements: A Discussion of In re Anzaldo and In re Rhodes

This program will provide an update on what counsel should consider in deciding whether to certify a reaffirmation agreement given the recent decision of In re Rhodes, No. 21-02804-MM7, 2021 Bankr. LEXIS 3387, at *1 (Bankr. S.D. Cal. Dec. 9, 2021). 

The Honorable Margaret M. Mann and Diane H. Gibson, Esq. will discuss the In re Anzaldo and In re Rhodes decisions and the considerations necessary in determining whether to certify a reaffirmation agreement. The discussion will focus on the prerequisites for a ride-through order, lender threats, ipso facto clauses, and how the reaffirmation decision is complicated when the collateral is a mobile home.
